The Industrial Relations Code, 2020 is one of India’s most significant labour law reforms, enacted to consolidate and modernize laws relating to trade unions, industrial disputes, standing orders, layoffs, retrenchment, and workforce relations. The Code amalgamates three major legislations—the Trade Unions Act, 1926, Industrial Employment (Standing Orders) Act, 1946, and Industrial Disputes Act, 1947—into a unified framework aimed at simplifying industrial relations and improving ease of doing business.
The primary objective of the Code is to create a balanced ecosystem between employer flexibility and worker protection by streamlining dispute resolution mechanisms, formalizing industrial relations processes, and promoting industrial harmony. It introduces structured provisions relating to recognition of negotiating unions, fixed-term employment, reskilling obligations, strikes and lock-outs, grievance redressal committees, and retrenchment thresholds.
A key highlight of the Code is the increase in the threshold for prior government approval for layoffs, retrenchment, and closure from 100 workers to 300 workers, subject to state modifications. It also establishes a Worker Re-Skilling Fund to support employees affected by retrenchment and promotes digitization and time-bound dispute resolution mechanisms.
The Code received Presidential Assent on 28 September 2020 and was notified in the Official Gazette on the same date. However, its enforcement remains subject to notification of effective dates and implementation rules by Central and State Governments.
Strategically, the Industrial Relations Code, 2020 marks a transition from fragmented labour governance to a modern, compliance-driven industrial relations framework aligned with India’s evolving economic and employment landscape.
